LM Welder Control – Terms of Service

Welcome to LM Welder Repair and the LM Welder Control ecosystem (“LMWC”).
These Terms of Service (“Terms”) govern your use of the LM Welder Control App, website, cloud services, wireless remotes, firmware, hardware products, and any related services (“Services”).

By accessing or using any LMWC Service, you agree to these Terms, our Privacy Policy, EULA, and any rules applicable to specific features (including the Marketplace Rules).

If you do not agree, do not use the Services.

1. Acceptance of Terms

By using LMWC Services, you acknowledge and agree that:

• The Data & Permissions Disclosure
  
  

• Marketplace Rules
  
  

• Any supplemental hardware or firmware notices
  
  

all together form a binding agreement between you and LM Welder Repair (LMWR).

2. No Liability for Equipment Misuse

Welding equipment and high-power control systems are inherently dangerous.
You acknowledge and agree that:

• You assume all risks associated with operating welding equipment
  
  

• LMWR is not responsible for injuries, equipment damage, property damage, or operational errors
  
  

• Incorrect voltage, amperage, mode selection, waveform settings, or machine modifications are solely your responsibility
  
  

• You must ensure safe distances when controlling equipment remotely
  
  

• You must follow all manufacturer instructions, OSHA requirements, and jobsite regulations
  
  

LMWR provides the tools, but you are solely responsible for safe operation.

3. Marketplace Disclaimer

The LMWC Marketplace allows users to buy and sell welding machines, tools, and accessories.

LMWR is not:

• A party to Marketplace transactions
  
  

• Responsible for the condition, safety, legality, or accuracy of listings
  
  

• Responsible for fraudulent listings or misrepresentations
  
  

• Responsible for disputes, refunds, damages, or losses arising from any transaction
  
  

Users must verify equipment, meet safely, and use their own judgment when buying or selling.

LMWR may remove listings that violate Marketplace Rules or applicable laws.

4. User Content & Responsibilities

Users may upload photos, descriptions, profiles, and listings (“User Content”).
By uploading content, you confirm that:

• You own or have the right to use the content
  
  

• You grant LMWR a non-exclusive license to display and distribute the content within the Services
  
  

• You will not upload copyrighted material you do not have rights to
  
  

• You will not list stolen, prohibited, or illegal items
  
  

• You will not upload misleading, harmful, or fraudulent information
  
  

LMWR may remove User Content at any time for:

• Marketplace violations
  
  

• Intellectual property infringement
  
  

• Unsafe or illegal listings
  
  

• Spam, fraud, or policy violations
  
  

5. Safety Requirements

You agree to:

• Operate welding equipment responsibly
  
  

• Maintain a safe distance when using wireless or remote controls
  
  

• Follow all safety guidelines from machine manufacturers
  
  

• Follow OSHA, jobsite, and local safety laws
  
  

• Ensure your machine is in safe working condition before remote operation
  
  

• Never use the App or hardware in hazardous environments where wireless control could cause injury
  
  

Failure to follow safety requirements may result in account termination.

6. Intellectual Property & Trade Secrets

All LMWC materials are protected by copyright, trademark, and trade-secret laws, including:

• Software, firmware, and code
  
  

• Hardware designs, schematics, and PCB layouts
  
  

• Communication protocols (BLE, LoRa, wireless integrations)
  
  

• Algorithms, AI models, waveform control logic
  
  

• Branding, logos, trademarks, and graphics
  
  

• App designs, UI layouts, and website content
  
  

You agree not to:

• Copy, clone, or reproduce LMWC hardware or firmware
  
  

• Reverse engineer, decompile, or extract source code
  
  

• Create competing or derivative products
  
  

• Reproduce any LMWR intellectual property without permission
  
  

Violations may result in immediate account termination, legal action, and damages claims.

7. Account Termination & Suspension

LMWR may suspend, restrict, or terminate your account for:

• Violation of these Terms
  
  

• Marketplace fraud or misrepresentation
  
  

• Safety breaches
  
  

• Intellectual property violations
  
  

• Unauthorized copying or reverse engineering of hardware or software
  
  

• Abusive behavior, harassment, spam, or criminal activity
  
  

Termination may include disabling access to:

• Marketplace listings
  
  

• Cloud features
  
  

• Wireless control and telemetry syncing
  
  

• Support services
  
  

You may request account deletion at any time.

8. Service Modifications

LMWR may modify, update, or discontinue parts of the Services at any time, including:

• App features
  
  

• Hardware compatibility
  
  

• AI or machine-learning capabilities
  
  

• Cloud services or Marketplace functionality
  
  

Some features may require firmware or app updates to maintain safe operation.

LMWR is not liable for interruptions, changes, or discontinuation of service.

9. No Warranty

All Services are provided “as-is” and “as available.”
LMWR makes no warranties, express or implied, including:

• Fitness for a specific purpose
  
  

• Non-infringement
  
  

• Performance guarantees
  
  

• Compatibility with modified machines
  
  

You use the Services at your own risk.

10. Limitation of Liability

To the fullest extent allowed by law:

LMWR is not liable for:

• Personal injury or death
  
  

• Equipment or property damage
  
  

• Welding defects or faulty settings
  
  

• Lost revenue or downtime
  
  

• Misuse of wireless controls
  
  

• Incorrect machine configuration
  
  

• Marketplace losses
  
  

• Firmware modification or third-party interference
  
  

• Data loss or corruption
  
  

Your sole remedy is to discontinue use of the Services.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

Any legal claims must be filed in courts located in Texas.
