LM Welder Control – End-User License Agreement (EULA)

This End-User License Agreement (“Agreement”) is a legal agreement between you (“User”) and LM Welder Repair, LLC (“LMWR”), governing your use of the LM Welder Control App, its firmware, hardware, associated accessories, cloud services, and any updates, data models, or AI-powered features (collectively, the “LMWC System”).

By installing, accessing, or using any part of the LMWC System, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. License Grant

LMWR grants you a non-exclusive, non-transferable, revocable, limited license to:

• Use the LMWC System solely for your own welding equipment,
  
  

• Access LMWR’s firmware, software, and online services,
  
  

• Install official updates provided by LMWR.
  
  

No rights are granted beyond those expressly stated.

2. Intellectual Property & Trade Secret Protection

The LMWC System contains trade secrets, proprietary algorithms, hardware designs, communication protocols, data models, BLE/LoRa frameworks, control mappings, and AI-training architectures owned exclusively by LMWR.

You may not, under any circumstance:

2.1 Reverse Engineering & Decompilation

• Reverse engineer
  
  

• Disassemble
  
  

• Decompile
  
  

• Attempt to derive source code, algorithms, or communication protocols
  
  

2.2 Copying & Redistribution

• Copy, modify, replicate, or redistribute any part of the app, firmware, hardware, or embedded logic
  
  

• Create derivative works
  
  

• Publish, leak, or disclose proprietary information
  
  

2.3 Hardware & Firmware Cloning

• Copy or clone the hardware design, PCB layouts, firmware logic, wireless protocols, PIN maps, BLE characteristics, or control sequences
  
  

• Use the LMWC System to develop competing or similar hardware or software solutions
  
  

2.4 Non-Commercial Use

You may not:

• Use the system to provide competing commercial products
  
  

• Build or support products that duplicate, replicate, or mimic the LMWC System
  
  

Any unauthorized use constitutes:

• Breach of contract
  
  

• Misappropriation of trade secrets
  
  

• Violation of intellectual property law
  
  

LMWR reserves the right to pursue civil and criminal remedies.

3. Data Collection, Telemetry, and AI Learning

To provide diagnostics, remote monitoring, machine history logs, and future AI-driven welding features, you consent to LMWR collecting and processing the following types of data:

3.1 Machine & Sensor Data

• Voltage, amperage, duty cycle
  
  

• Machine state, runtime hours, shutdown events
  
  

• Error logs, sensor readings, diagnostic codes
  
  

• Component health, temperature, arc start events
  
  

3.2 Usage Data

• Welding settings and adjustments
  
  

• Frequency of parameter changes
  
  

• How the system responds to load / arc conditions
  
  

• Patterns used during operation
  
  

3.3 Device & App Telemetry

• Device model and firmware version
  
  

• Connectivity status (LoRa/BLE/Wi-Fi)
  
  

• Crash logs and performance metrics
  
  

3.4 AI Training & Model Improvement

You agree that LMWR may:

• Store machine data
  
  

• Analyze operational patterns
  
  

• Use anonymized welding data to train, improve, or develop machine-learning models
  
  

• Use aggregated data for predictive maintenance, arc-stability improvements, and next-generation features
  
  

All collected data is processed according to LMWR’s Privacy Policy.

4. User Permissions

The app may request access to:

• Microphone (voice commands)
  
  

• Bluetooth / wireless communication
  
  

• Location (repair shop map, machine location in logs)
  
  

• Camera (optional scanning of machine profiles)
  
  

These permissions are used only for app functionality.

5. Safety, Firmware, and Hardware Risks

You acknowledge that welding equipment and high-power electrical control systems are inherently dangerous.

You agree that:

• You assume all responsibility for safe operation
  
  

• You will follow all manufacturer safety procedures
  
  

• LMWR is not liable for any injury, damage, fire, arc flash, or malfunction resulting from use
  
  

The LMWC System must be used only with compatible machines and within its published limits.

6. Updates & Modifications

LMWR may push or require:

• Firmware updates
  
  

• Bug fixes
  
  

• Hardware compatibility changes
  
  

• Safety updates
  
  

• AI-feature improvements
  
  

You agree to install updates promptly to maintain safe operation.

LMWR may discontinue features at its discretion.

7. Limitations of Liability

To the fullest extent permitted by law, LMWR is not liable for:

• Physical injury or death
  
  

• Weld defects, arc instability, or incorrect settings
  
  

• Equipment or property damage
  
  

• Downtime or lost revenue
  
  

• Loss of data or telemetry
  
  

• Marketplace transactions
  
  

• Unauthorized access due to user negligence
  
  

• Use of the device in unsafe conditions
  
  

• Modifications, third-party hardware, or unauthorized firmware
  
  

Your exclusive remedy is to stop using the LMWC System.

8. Termination

LMWR may suspend or terminate your access if:

• You violate this Agreement,
  
  

• You attempt to tamper with firmware or hardware,
  
  

• You interfere with AI systems, telemetry, or proprietary protocols.
  
  

Upon termination, you must stop all use and uninstall the app.

9. Governing Law

This Agreement is governed by the laws of the State of Texas, without regard to conflict-of-law principles.

10. Severability

If any part of this Agreement is found unenforceable, the remaining sections remain in full force.

11. Entire Agreement

This Agreement constitutes the entire understanding between you and LMWR regarding the LMWC System.
